OPINION AND ORDER

BUTLER, Chief Judge.

The plaintiffs, Negro school children in Franklin County, North Carolina, instituted this class action on December 8, 1965, pursuant to 42 U.S.C.A. § 1983, on their own behalf and on behalf of other Negro children similarly situated, to desegregate the Franklin County School system. The complaint alleged in susbtanee that the Franklin County Board of Education was operating- a .racially segregated school system and, in so doing, was denying the plaintiffs and members of their class the equal protection of the laws.
