Appeal from an order of the Supreme Court (Malone, Jr., J.), entered October 22, 2004 in Albany County, which, inter alia, partially granted defendants’ motion for summary judgment dismissing the complaint.
Plaintiff purchased a building lot from defendants, in a *918subdivision that defendants developed, and built his residence upon it.
