Affirming.

In 1909 this action was filed in the Jefferson Circuit Court to settle the estate of Emma Thomas, who died a resident of Jefferson county in 1908. 'A. W. Dorsey, an escheator .appointed by the State, who was made a defendant, came into the action, and set up on béhalf of the Commonwealth that Emma Thomas died intestate, the owner of considerable property, as well as some real estate situated in the city of Louisville. He asked that upon the settlement of the estate any surplus left after the payment of debts vest in the Commonwealth of Kentucky…
