Pending before the Court is Defendant’s Motion to Dismiss (ECF No. 23). For the reasons stated below, the Court DENIES the Motion.
Statement of Facts
Plaintiff Batina Adkins, acting individually and as next friend and guardian for her infant son Draven Robertson, commenced the instant litigation on January 17, 2012. Compl., ECF No. 1. Plaintiff alleges that Valley Health Systems, Inc.
