Appeal by the defendant from a resentence of the Supreme Court, Queens County (Buchter, J), imposed October 16, 2008, upon his conviction of manslaughter in the first degree, upon his plea of guilty.

Ordered that the resentence is affirmed.

On October 18, 2004, the defendant pleaded guilty to man*983slaughter in the first degree and was sentenced on January 11, 2005, to a determinate term of 12 years imprisonment.
