The first question that confronts the court in the consideration of this case is a motion on the part of the defendant in error to dismiss the • petition in error for the reason that no case 'was made and served in time as provided by law. This case was tried in the district court at the September term, 1890. *588On. the 20th day of September the jury returned a verdict ; on the same day the plaintiff in error filed its motion for a new trial.
