This is an action based on fraud. It arises out of tbe sale of United States G-overnment securities owned by the plaintiff, which he requested the defendant to- sell for him. It is the plaintiff’s contention that he should have received the sum of $12,962.37 —■ the net proceeds of the sale over and above the satisfaction of the debts incurred in the purchase of the securities for which they were given as collateral.
