This is an action in equity which was instituted in the Court of Common Pleas of Summit county to enjoin the village of Hudson and its officers, and certain county officials, from collecting or attempting to collect a certain assessment, payable in nine annual installments, against real estate now owned by Phyllis E. Gaylord, appellee.

The court below found that the assessment was in excess of the benefit, and ordered the excess amount abated. The cause has been appealed to this court on questions of law and fact by the village of Hudson, and has been submitted upon certain testimony taken in…
