MEMORANDUM OPINION AND ORDER

KANE, Senior District Judge.

Petitioner Dan Quoc Le is a 27-year old Vietnamese immigrant who arrived in this country in 1992 as a refugee with his family. He was convicted the following year on an aggravated robbery charge and sentenced to prison. He completed his sentence in 1997 and was immediately transferred to the Immigration and Naturalization Service’s (INS’s) Wackenhut detention facility in Denver pursuant to a final order of deportation.
