Appeal from Dubuque District Court. At tbe November term of tbe District Court for Dubuque county, for tbe year 1859, Edward Mooney was indicted for tbe murder of one Charles Wood. At tbe same term be was tried, convicted and sentenced to be executed. The defendant appeals. Tbe questions presented by tbe appellant necessary to be passed upon by this court appear in tbe opinion.

I. It is submitted by tbe appellant that tbe court erred in refusing to sustain tbe challenge of defendant to tbe panel of the grand jury. Upon tbe 7th day of November, 1859, tbe grand jury for tbe county of Dubuque ivas regularly empanneled for tbe term of tbe District Court commencing on that day. Upon the 9th day of tbe same month, the murder of Woods, with which defendant is charged, iras *508committed.
