Defendant Copto-Lavalle seeks to appeal the October 12,2001, order of the Fairfax General District Court denying his Motion to Set Aside Judgment. He had been convicted of Driving While Under the Influence [of Alcohol] by the General District Court on August 3,2001, but no appeal was noted to the underlying conviction. Copto-Lavalle claims that he is entitled to a de novo trial in this court based upon his appeal from the order denying his Motion to Set Aside Judgment.
