for the Court:

¶1. Stewart Vaughn appeals from the judgment of the Circuit Court of Rankin County sentencing him, as a habitual and subsequent drug offender, to a term of sixty years in the custody of the Mississippi Department of Corrections (MDOC) for his conviction of the sale, of methamphet amine. He asks this Court to decide whether, during trial, the circuit court erred in failing to sua sponte exclude certain evidence and whether the amendment of the indictment prejudiced his defense.

¶ 2. Finding no error, we affirm.
