The petitioner seeks a divorce from the defendant, and bases her claim, to a decree upon the statutory offence of desertion, which she says was committed in August, 1898. Both parties were then and, so far as the evidence shows, always had been residents of the State of New York until January 38th, 1903, when the petitioner came to this state, as she asserts, with the' intention of making it her permanent home, the defendant now being a resident of Hew York State.
