Plaintiff in error was convicted and sentenced for a contempt of court. He appeared before the court below in response to a notice to show cause, and filed his answer, stating the material facts and circumstances attending the alleged contempt. His motion for *5a trial by jury was overruled and judgment entered against him upon the pleadings, viz., affidavits and answer.
