OPINION

MATTHEWS, Justice.

William Howarth appeals from the superi- or court’s grant of summary judgment against him in a malpractice suit which he brought against his former attorney, Edward Welch, and the Public Defender Agency.

I. FACTS AND PROCEEDINGS

Howarth was arrested and charged with the first degree sexual assault of L.M. on May 30, 1981. Welch, an employee of the Public Defender Agency, was assigned to represent him.
