—In an action to recover damages for personal injuries, the plaintiff appeals, as *339limited by his brief, from so much of an order of the Supreme Court, Kangs County (Harkavy, J.), dated March 8, 2002, as denied that branch of his motion which was for summary judgment on the issue of liability on his claim pursuant to Labor Law § 240 (1) against the defendants BFC Partners, L.P., and BFC Corp.

Ordered that the order is reversed insofar as appealed from, on the law, with costs, and that branch of the motion is granted.
