1. The record 'in this case presents the second trial in the lower court and the second appearance of this case here. See McCowen v. Aldred, 85 Ga. App. 373 (69 S. E. 2d 660). When the case was here before, this court fully discussed the question of partnership as applied to the facts in this case. The case was reversed and remanded for a second trial on allegedly newly discovered evidence on behalf of the plaintiff in error, McCowen (hereinafter called the plaintiff).
