McFADDEN, Justice.

William D. Collins, as prosecuting attorney for Boise County, Idaho, instituted this original proceeding seeking a writ of mandate against Ariel L. Crowley as a magistrate of the Fourth Judicial District of the State of Idaho for Boise County. Plaintiffs petition sought to require the defendant magistrate to continue with the arraignment of a certain individual who was then before the magistrate’s division of the-district court on a misdemeanor charge.
