In this cause, Carl R. Hastings, who was plaintiff in the lower court, appeals in error from a judgment of the Circuit Court of Shelby County based on a peremptory instruction by Hon. William W. O’Hearn of Division VHI of that Court, granted at the conclusion of all the proof. The defendant, Dr. Max Hughes also appeals in error because of failure or refusal of the trial judge to grant his motion for a directed verdict at the conclusion of the plaintiff’s proof.
