Before this Court, Robert Julian Ware, Betty Jean Workman, Almonta Creak and Roger Ware, appellants/petitioners below (hereinafter referred to as the “Appellants”) appeal from an order of the Circuit Court of Randolph County granting a new trial to Almira Jane Howell, executrix of the estate of Biddie L.
