This is an action for wrongful death. Plaintiffs’ complaint alleges that on the afternoon of June 25, 1971, defendant police officers, while in the course of duty, without provocation, intentionally shot deceased. Damages of $1,500,000 are. sought. Defendant City of Detroit appeared, and moved for summary judgment on the grounds of sovereign immunity provided in MCLA 691.1407; MSA 3.996(107). The motion was granted and the City of Detroit dismissed as a defendant, with proceedings against the remaining defendants stayed pending appeal. Plaintiffs appeal.
