The remaining parties to this suit, Mercantile National Bank at Dallas and Mercantile Dallas Corporation (collectively “MNB”) and Conveyor, Machinery and Steel Erectors, Inc. (“CoMaster”), have filed cross-motions for summary judgment under Rule 56 of the Federal Rules of Civil Procedure.
