Alleging that he was the owner and in possession of a certain tract of land described in his petition, and that the defendant was claiming title thereto under a deed from C. C. Howard, which clouded his title, plaintiff, W. B. Kelly, Sr., brought this action against defendant, Cumberland Company, a corporation, to have the deed in question canceled and the cloud removed from his title.
