The defendant was charged by a felony complaint with rape in the second degree (Penal Law § 130.30) and endangering the welfare of a child (Penal Law § 260.10 [1]). Pursuant to a plea bargain, the defendant pleaded guilty to one count of attempted rape in the third degree (Penal Law §§ 110.00, 130.25) and was sentenced to six months in jail.
