WILL, District Judge.

Petitioner, Grester Arnold, filed a Request for Modification of a Department of Labor decision denying him black lung benefits under the Federal Coal Mine Health and Safety Act of 1969, 30 U.S.C. § 901 et seq. The Office of Worker’s Compensation Programs (“OWCP”) denied Arnold’s request, and appeals to an Administrative Law Judge (“ALJ”) and the Benefits Review Board (“the Board”) affirmed that decision.
