delivered the opinion of the court:

The defendant John Leon Dismuke and one James L. Watkins were indicted together and tried together on a charge of Armed Robbery. The defendant appeals from the judgment of conviction after a jury verdict, and from the 3-9 year sentence imposed.

Defendant first argues that the conviction should be reversed because, although he requested a lawyer, he was denied effective assistance of counsel at the July 8th, 1969, “line-up” held the day following his arrest and before indictment. He urges that the court committed constitutional…
