On August 8, 2005, the defendant was charged by complaint in the Barn-stable Division of the District Court Department with operation of a motor vehicle while under the influence of alcohol in violation of G. L. c. 90, § 24(l)(a)(l), and with negligent operation of a motor vehicle in violation of G. L. c. 90, § 24(2)(fl).
