HAIRE, Judge.
Andrew J. and Mary R. Evans, appellants herein, brought an action against appellee Speros and various other defendants seeking rescission or, in the alternative, damages for fraudulent misrepresentations allegedly made concerning certain land transactions between the parties. The action was commenced by the filing of the complaint on September 24, 1963.
