In the month of October, in the year 1870, Kleeman & Co., the appellants, were engaged in the business of manufacturing and repairing billiard-tables in the city of Chicago, Illinois, and also had a branch of the establishment in the city of New Orleans.
It is alleged by Wm. Collins, the appellee, that a verbal contract was made between the appellants, Kleeman & Co., *462and himself by which he undertook to work for the appellants one year in their business house in New Orleans for the sum of one thousand dollars.
