Donald Walters (hereafter Donald) appeals from an adverse judgment in his action to impose a constructive trust on the proceeds of a note and deed of trust assigned to respondent, Lola Calderon, by Donald’s deceased adoptive father, William S. Walters (hereafter dece dent). Donald contends that: 1) as a donee beneficiary, he is entitled to quasi-specific performance of decedent’s promise to- convey the property to him in a 1942 agreement between the Tauzers and decedent; 2) his 1950 contract with decedent was valid, enforceable and supported by consideration; 3) Lola…
