Appeal from Linn District Court. — Hon. E. O. Ellison. Judge. Action for separate maintenance, which by amendment during trial was converted into an action for divorce. Defendant filed a cross-bill, and on the issues joined the case was tried to th'e court, resulting in a decree for plaintiff, and defendant appeals.

The testimony upon which the action was tried is not before ns, and the points relied upon for a reversal are technical and do not go to the merits of the controversy. The action originally was for separate maintenance, bottomed upon cruel and inhuman treatment, endangering plaintiff’s health and life. Defendant denied the charge and asked for a divorce from plaintiff based largely upon the same kind of treatment from plaintiff and an inferential charge that plaintiff had been guilty of adultery.
