Partlow v. Illinois Central Railroad

The plaintiff in error brought an action against the defendant in error for causing the death of the intestate. A trial by jury resulted in a verdict and judgment thereon for the defendant.

The intestate was fatally injured by a collision with a passenger train on defendant’s road at a'crossing in the village of Humbolt. The train was one of the fastest on the road and made no stop at this station. It was running forty to fifty miles an hour.
