MEMORANDUM OF DECISION AND ORDER

SPATT, District Judge.

The plaintiff Peter Solomon (“Solomon” or the “Plaintiff’), a former pre-trial inmate at the Nassau County Correctional Center (“NCCC”), commenced this action against the remaining defendants Nassau County, NCCC, Sheriff Edward Reilly (“Reilly”), and Undersheriff Michael Sposato (“Sposato”) pursuant to 42 U.S.C. § 1983 (“Section 1983”) alleging that his civil rights were violated when he was bitten by a rodent in his jail cell.
