WILKINS, District Judge.

This Indictment contains two counts. The first charges the defendant with “being employed,” and the second with “aiding and assisting” in removing “timber from lands of the United States.” The description of the offense is in these words: “That George Schuler, late of the village of Muskegon, in the county of Ottawa, on the 20th of June, 1853, at the mouth of the river Muskegon aforesaid, was employed in removing from lands of the United States, a large amount of timber, to wit: one hundred thousand shingles and twenty cords of shingle bolts, the property of the United…
