This case is before us on certified question from the Court of Civil Appeals at Fort Worth.
The Honorable James E. Kilday brought suit in the district court against the State Democratic Executive Committee and others to enjoin the Committee from placing any other than his own name on the ballot for the July, 1942 Democratic Primary, as a candidate for nomination to the office of Railroad Commissioner, to fill the unexpired term of the Honorable Jerry Sadler.
