SKINNER, Circuit Judge.

This is an action brought by the state of South Dakota on the relation of Jennie Bly, plaintiff and respondent, against 'Leonard Wold, defendant and appellant, and in the complaint the defendant is charged with being the father of the bastard child born to the relatrix February, 1922, in the county of Minnehaha, state of South Dakota; and to this complaint the defendant entered a plea of “not guilty.” The case was tried to a jury, and the jury returned a verdict in favor of plaintiff and against the defendant and finding that the defendant was the father 'of the child…
