Appeal from a judgment of the Supreme Court (Pritzker, J.), entered April 16, 2009 in Washington County, which denied petitioner’s application for a writ of habeas corpus, in a proceeding pursuant to CPLR article 70, without a hearing.
Following his 1994 conviction of murder in the second degree, petitioner was sentenced to 25 years to life in prison. His conviction was subsequently affirmed on appeal (People v Spaulding, 222 AD2d 312 [1995], lv denied 88 NY2d 942 [1996]).
