BERANEK, Judge.

Defendant appeals from an adverse summary judgment contending that material issues of fact precluded disposition of the matter in a summary manner. The controversy arises from plaintiff/appellee’s attempt to buy a condominium unit from the defendant/appellant. In 1979, the parties entered into a contract for the purchase of the condominium unit. The initial contract did not contain certain clauses concerning cancellation and oral representations as required by Section 718.503(l)(a) and (b), Florida Statutes (1981).
