MEMORANDUM OPINION AND ORDER

SIMPSON, District Judge.

This matter is before the court on motion of the defendant, McKenzie Mattingly, for summary judgment on the grounds of qualified and official immunity. This action alleges violation of the civil rights of the plaintiffs decedent, Michael Newby, when he was shot by Mattingly during an undercover drug operation. Mattingly was serving as an undercover narcotics officer for the Louisville-Jefferson County Metro Police Department David District Flex Platoon.
