RIDGE, District Judge.

At a hearing on the writ of habeas corpus issued herein the following facts were developed:

May 7, 1934, in cause No. 8824, in the U. S. District Court for the Middle District of Pennsylvania, an indictment was returned against petitioner, charging petitioner in three counts with uttering, passing and possessing counterfeit notes of the Federal Reserve Bank of New York, in violation of Section 151, of the Criminal Code, Title 18 U.S.C.A. § 265.
