Introduction

In this case we consider whether the Department of Mental Health (“DMH”) erred in its decision that a direct care provider was guilty of brutal and inhumane treatment. The Audrain County Circuit Court, the Honorable Keith M. Sutherland presiding, reversed the decision and order. 1 By its order, the DMH placed Jessica Oakes’ (“Oakes”) name on the Department’s Disqualification Registry for life pursuant to Section 630.170 RSMo and 9 CSR 10-5.200(11).
