The indictment is for murder; the conviction for manslaughter; punishment fixed at confinement in the penitentiary for a period of five years.
The deceased, C. W. Ray, was a physician. He had been treating the wife of the appellant for some time for tuberculosis. He and Dr. Jenkins had adjoining offices and used the reception room in common.
