OPINION OF THE COURT

Chief Judge Kaye.

This case presents the question whether the People’s failure to inform the defendant that the complainant had previously operated as an informant for the local police department violated defendant’s right to due process. We conclude that the People were required to disclose this information pursuant to Brady v Maryland (373 US 83) and therefore reverse defendant’s conviction.
