— In an action to recover damages for wrongful death, defendants appeal from a judgment of the Supreme Court, Queens County, entered June 3, 1971, in favor of the plaintiff, upon a jury verdict of $30,000. Judgment reversed, on the law, and new trial granted, with costs to abide the event. No questions of fact were presented on this appeal. The record reveals that on Saturday afternoon, October 28, 1967, plaintiff’s intestate, a six-year-old male, was found lying unconscious on the property of defendant Dougbay Estates, on building material in the front yard of a house under construction.
