SMITH, Judge.

Petitioner, William H. Peace, III, appeals a superior court order reversing a State Personnel Commission decision which reinstated petitioner as an employee of respondent, the Employment Security Commission of North Carolina (“ESC”). ESC appeals a superior court order affirming an Office of Administrative Hearing (“OAH”) decision finding a Title VII violation and reinstating petitioner. After carefully reviewing the record, we agree with petitioner’s contention that ESC has failed to show that it dismissed petitioner with just cause. Therefore, we affirm the decision of the State…
