This is a suit for the value of 3.7 acres of land and the buildings thereon, taken and destroyed by the board of commissioners of the Pontchartrain levee district for levee purposes. The land taken was the front portion of a tract containing 30 acres, assessed at $15,000 for the taxes of the preceding year. The sixth section of article 16 of the Constitution, 1921, provides that lands and the improvements thereon used or destroyed for levee purposes shall be paid for at a price not exceeding the assessed value for the preceding year.
