Milton, J.:

Appellant was convicted before a jury in the district court of Harvey county of a violation of the prohibitory law and was sentenced by the court to pay a fine of $100 and to be imprisoned thirty days in the county jail. The information charged that on the 26th day of August, 1897, the defendant “did then and there unlawfully, without taking out a permit from the probate judge of said county, bargain, sell and give away intoxicating liquor.” The defendant’s motion to quash the information was overruled, as was also his motion to require the…
