The petitioner in this case, E. B. (Lash) Ferguson, was charged jointly with another in a county attorney’s information, filed in the district court of Mahaska County, with the crime of larceny alleged to have been committed in June, 1935. The subject of the larceny being a bunch of cattle. Ferguson was tried separately for the offense charged, was found guilty and appealed to this court from a judgment committing him to the penitentiary.
