Appellee, Carolina T. Dinger, began an action of assumpsit in the circuit court of Lee county against appellant to recover upon a certificate of insurance issued to her husband, Carl A. Dinger. The, declaration consisted of one count upon the certificate and the common counts in assumpsit. A plea of the general issue was filed, with a stipulation that the defendant might offer under it any defense or produce any evidence which could be introduced under any special plea, etc. The cause was tried by a jury, and at the close of the evidence the defendant asked the court to instruct the jury to…
