MEMORANDUM AND ORDER

JOYNER, District Judge.

Presently before the Court is the Motion to Proceed In Forma Pauperis of Plaintiff Anthony M. DiGiamocomo (“Plaintiff’ or “DiGiamocomo”). For the reasons that follow, the Court will grant Plaintiffs Motion to Proceed In Forma Pauperis, but will dismiss his complaint as legally frivolous without prejudice.
